1. Acceptance of Terms

By accessing and using StayHaven's services, website, and member facilities, you agree to be bound by these Terms & Conditions in their entirety. These terms establish the legal relationship between you and Capital Bridge REI LLC, operating as StayHaven. If you do not accept these terms, you may not use our services or participate in our membership program. Your continued use of StayHaven services constitutes your acceptance of these terms.

2. Membership Overview

StayHaven membership grants you a personal-use license to access furnished living accommodations across our portfolio of properties, located in Winter Haven, Florida and surrounding areas. This is a weekly membership agreement that provides flexible housing access, not a traditional residential lease or rental agreement. As a member, you are granted the right to occupy a designated suite within one of our member properties for the duration of your active membership. You understand and acknowledge that this is a membership relationship distinct from a landlord-tenant relationship, and therefore certain statutory protections afforded to tenants may not apply to members. Your membership grants you access to a curated selection of well-maintained, furnished homes designed for corporate housing, extended stays, and flexible living arrangements.

3. Application & Move-In Fees

Applying for StayHaven membership involves two separate fees. First, a one-time, non-refundable Background Check Fee of $50.00 is required at the time of application submission. This fee must be paid before any screening process begins and covers the cost of the third-party background check, which includes criminal history, eviction records, sex offender registry, and identity verification. The Background Check Fee is non-refundable under all circumstances, including denial of the application, withdrawal of the application, or failure to complete the screening process.

Second, upon approval of your application, you are required to pay a one-time, non-refundable Membership Activation Fee of $200.00, together with your first week's membership dues at the rate corresponding to the membership tier you selected. Both amounts must be paid in full before you take occupancy. The Membership Activation Fee covers administrative processing, onboarding, document handling, and systems setup required to establish your membership account. The Membership Activation Fee is non-refundable under all circumstances, including early termination of membership. StayHaven does not collect a security deposit.

4. Weekly Payments

StayHaven membership fees are billed and due on a weekly basis. You will receive a QuickBooks invoice each week that details your membership dues for the upcoming week. Payment is due within the timeframe specified in your invoice, typically within seven days of invoice issuance. Payments must be made according to the payment instructions provided on your invoice, which may include electronic transfer, automated payment setup, or other authorized payment methods. Late payment of weekly fees may result in immediate termination of your membership without further notice. We reserve the right to suspend access to your suite and member facilities if payment becomes 24 hours overdue. Continuous non-payment may result in legal action to recover unpaid fees and associated costs.

5. Background Check & Screening

All applicants are required to complete a comprehensive background screening process as a condition of membership approval. By submitting an application to StayHaven, you authorize us to obtain and review background information including criminal history, eviction records, and identity verification. Our screening process complies with the Fair Credit Reporting Act (FCRA) and all applicable federal, state, and local laws governing consumer reports and background checks. You have the right to dispute any information contained in your background report. Upon request, we will provide you with the name and contact information of any third-party background check provider used in your screening. StayHaven reserves the right to deny membership based on the results of the background screening, and you will be notified in writing if your application is denied on these grounds.

6. Member Conduct

All members must conduct themselves in a manner that respects the rights and peaceful enjoyment of other members and property staff. You agree to respect all common areas, including kitchens, living rooms, laundry facilities, and outdoor spaces. Excessive noise, disruptive behavior, or harassment of other members or staff is prohibited and may result in immediate membership termination. You are required to observe designated quiet hours, typically between 10:00 PM and 8:00 AM, during which loud music, excessive conversation, and other noise-generating activities must cease. Illegal activity of any kind, including but not limited to drug use, theft, violence, or unlawful conduct, is strictly prohibited and will result in immediate termination and potential legal action. Unauthorized overnight guests are not permitted in your suite; any guest occupancy must be pre-approved by StayHaven management. You are responsible for maintaining your suite in a clean and sanitary condition and must immediately report any damage or maintenance issues to property management.

7. Property Rules

Shared spaces throughout StayHaven properties are maintained collectively by all members under the expectation of mutual respect and cleanliness. All members are responsible for cleaning up after themselves in common areas, including the kitchen, dining areas, living rooms, and bathrooms. Dirty dishes, food waste, and personal items must never be left unattended in shared spaces. Kitchen cleanup must be completed immediately after use, and all cookware and utensils must be washed and returned to storage. Laundry etiquette is essential; members must not leave clothing in washers or dryers for extended periods, as this prevents other members from using the facilities. Each member should fold or remove their laundry within 30 minutes of completion to maintain fairness and access for all. Parking rules must be observed at each property; assigned parking spaces should not be encroached upon, and vehicles must be registered with property management. Guests' vehicles must be parked in designated visitor areas only. Any violations of property rules will be addressed by management and may result in warnings, fines, or termination of membership.

8. Termination & Move-Out

Either you or StayHaven may terminate your membership at any time by providing seven days of written notice to the other party. StayHaven membership is designed with flexibility in mind; you are not locked into a long-term lease obligation and may exit your membership with minimal advance notice. Written notice must be submitted to StayHaven management through the contact information provided in your membership agreement. Upon termination, you must vacate your suite, return all keys and access devices, and remove all personal belongings within the seven-day notice period or by the termination date specified in the notice, whichever is later. Your suite must be left clean and free of damage beyond normal wear and tear. Any repairs or cleaning required due to misuse or negligence will be charged to you. A final inspection will be conducted, and any unpaid fees or damage charges will be deducted from deposits or collected separately. StayHaven reserves the right to terminate your membership immediately for violation of these terms, illegal activity, non-payment, or other material breaches without providing the standard seven-day notice period.

9. Liability & Insurance

StayHaven and Capital Bridge REI LLC are not liable for loss, theft, damage, or destruction of personal property belonging to members, whether caused by other members, staff, environmental factors, or circumstances beyond our control. You assume all risk for your personal belongings while occupying a StayHaven suite. We strongly encourage all members to obtain insurance for personal belongings to protect your property while occupying a StayHaven suite. Personal belongings insurance is affordable and provides valuable protection that our membership agreement does not cover. StayHaven maintains property insurance covering the structure and StayHaven-provided furnishings, but this does not extend to your personal possessions. In the event of injury to any person or damage to property arising from your occupancy or conduct, you agree to indemnify and hold harmless StayHaven, Capital Bridge REI LLC, and their owners, employees, and agents from any claims, damages, or legal action resulting therefrom.

10. Modifications to Terms

StayHaven reserves the right to modify these Terms & Conditions at any time. Changes will be effective upon posting to our website or upon written notice to members. Your continued membership following the posting or notification of changes constitutes your acceptance of the revised terms. We will make reasonable efforts to provide advance notice of significant changes, and members will be notified via email or through our member portal when substantial modifications are made. If you do not agree with any modifications to these terms, you may terminate your membership in accordance with the termination procedures outlined in Section 8.

11. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. You agree that any legal action or proceeding arising from or relating to your StayHaven membership shall be brought exclusively in the state or federal courts located in Polk County, Florida. You consent to the jurisdiction and venue of such courts and waive any objection to venue or claim of inconvenient forum. This provision ensures that all disputes are resolved under Florida law and within the courts of Polk County.
